Each entrant should submit no more than one photo per month. Photos submitted may be chosen for use in our online Photo Gallery and, if the entry complies with the Terms and Conditions, will be entered into the Photo Contest for the period in which the photo was submitted.

Each entrant warrants the originality of each entry submitted and that all rights in each entry submitted, including the copyright in the image and the permission and release of any identifiable persons within the photograph, are held by the entrant at the time of submission. In consideration of accepting the submitted entry, the entrant grants Olympus America Inc. and Olympus Imaging America Inc., collectively “Sponsor,” and others acting under the authority of Sponsor, the right to copy, reproduce, publish, display, and use the photo and submitted information for any and all marketing, advertising, or publicity purposes. The photo may be cropped, edited, or otherwise altered in connection to this use.

Sponsor assumes no responsibility for lost or late entries. Sponsor reserves the right to reject any submission for any reason. All entries become the sole property of Sponsor and none will be returned.

General Regulations
All federal, state, provincial, territorial and local laws and regulations apply. This contest is void where prohibited by law. Each winner must sign an affidavit of eligibility in compliance with the rules and a publicity release within fourteen (14) days after notification is attempted. A consent and release of identifiable persons in the photograph must be provided. Failure to provide these releases will result in disqualification and the selection of an alternate winner. Unless prohibited by law, each entrant consents to the use by Sponsor, and others acting under the authority of Sponsor, of the entrant’s name, likeness and image for publicity purposes without additional compensation. In addition, each contest winner is responsible for paying any and all taxes on his or her prize(s).

By accepting prize, winner agrees that the Sponsor, its respective subsidiaries, affiliates, advertising and promotion agencies, and their directors, employees, representatives and agents, will have no liability whatsoever for, and will be held harmless by winner for any liability for any injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from the acceptance, possession, use or misuse of the prize or participation in this contest or any prize related activity.

In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

If for any reason the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest and award those prizes from among all eligible entries received prior to cancellation or termination. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Contest. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Application Format
Submissions of digital photos should be made through the online submission form located at: http://www.olympusamerica.com/cpg_section/oima_gallery_form.asp

Gallery
Sponsor will pick a number of the submitted photos to be featured in our online photo gallery. Photos submitted from entrants living in locations ineligible to win the contest may still be featured in the gallery.

Contest Eligibility
The contest is open to residents of the United States and Canada (excluding Quebec). Entrants must have reached the age of majority in their state, province or territory of residence as of the date of entry. Employees of Olympus America Inc., its respective affiliated or subsidiary companies, or members of an employee’s immediate family and/or those individuals living in the same household of each are NOT eligible.

Each photo submitted must have been (i) taken by the entrant and (ii) taken with an Olympus® camera. Photos taken with any other kind of camera will not be eligible. If it is determined after the winners are announced that any winning photo was taken with another kind of camera, the prize will be revoked and another winner announced.

Winners of an Olympus Photo Contest, i.e. - those entrants whose submission resulted in their winning a tangible prize from Sponsor such as an American Express® gift certificate, etc. - are not eligible to win the immediately subsequent Olympus Photo Contest. For example, a winner in the Winter 2008 Photo Contest will be ineligible to win the Spring 2008 Photo Contest but will be eligible to win the Summer 2008 Photo Contest.

Individual photos previously featured in the Olympus Photo Gallery or those photos that have previously won an award in an Olympus Photo contest are not eligible to win.

Entry Periods
Only entries originally submitted during the dates defined below are eligible for that period’s contest. Submission dates will be determined based on Eastern Standard Time.

The following periods apply to the photo contests to be held in 2008: Judging
Three (3) winners will be chosen per contest period. The photographs will be judged based on originality (30%), photographic quality (30%), composition (30%), and comments submitted with the photo – i.e. the story behind the photo, how the photo was taken, etc. (10%).

All judging decisions are final.

Announcement of Winners
Contest winners will be notified and provided with appropriate forms as outlined under “General Regulations.” Winners will also be identified in the Olympus Photo Gallery.

Prizes
Three $100 American Express gift certificate prizes will be awarded per contest period (one to each winner), for a total of 12 winners for 2008.
